What is OSGOR?

Compulsory insurance of the employer's civil liability for harm to the life and health of an employee in the performance of their labour or official duties is a type of compulsory insurance provided for by the legislation of the Kyrgyz Republic.

The object of insurance is the property interest of the employer related to their obligation to compensate for harm caused to the life and health of an employee in the performance of employment duties.

The OSGOR contract is concluded between the employer and the insurance organisation in favour of the employee who may be harmed in the performance of labour or official duties.

 

Who is OSGOR intended for?

The policyholders under OSGOR are employers to whom the requirements of legislation on compulsory insurance of employer's liability apply.

OSGOR is relevant for organisations and entrepreneurs who use the labour of employees and have the corresponding employer obligations.

The law provides that employer's liability insurance does not regulate the civil liability of an employer in relation to employees of state institutions.

 

What risks are associated with OSGOR?

An insured event is associated with the occurrence of the employer's civil liability for harm caused to the life or health of an employee in the performance of labour or official duties.

The consequences provided for by law include:

  •  - temporary total or partial loss of ability to work as a result of a work-related injury;
  •  - permanent total or partial loss of ability to work;
  •  - death of an employee as a result of a work-related injury;
  •  - occupational disease in cases provided for by legislation.

What does the sum insured and the cost of OSGOR depend on?

The sum insured is determined by the contract but must not be less than the annual wage fund of all employees in the relevant categories of personnel.

The insurance premium is calculated by applying the insurance tariff to the sum insured. The limits of tariffs are differentiated depending on the type of economic activity, the class of professional risk, and the category of personnel.

Term of the contract

As a general rule, the OSGOR contract is concluded for a period of 12 months from the date of entry into force. If the employer's activity is carried out for less than 12 months, the contract is concluded for the period of such activity.

The contract does not terminate automatically after the first insured event if the established insurance period continues.

 

How to take out OSGOR?

To apply, it is necessary to contact the insurance company and provide the information required to determine the sum insured and the premium.

  •  2. determine the categories of employees;
  •  3. determine the wage fund;
  •  4. determine the type of economic activity and the class of professional risk;
  •  5. calculate the insurance premium;
  •  6. submit an application;
  •  7. conclude the insurance contract;
  •  8. receive the insurance policy.
  • The compulsory insurance contract is concluded in writing on the basis of the policyholder's application.
